TelexFree class-action denied class certification


The long-running TelexFree class-action has been denied class certification.

The April eighth determination is a large stumbling block within the case, initially filed again in October 2014.

Plaintiff Anthony Cellucci sought to determine a category, consisting of

all individuals that made a fee to TelexFree and suffered a [n]et loss … outlined as inserting extra funds into TelexFree than the full fund withdrawn from TelexFree.

In denying class certification, the courtroom examined points with jurisdiction, and willpower of damages (notably with respect to separating net-winners from victims).

On April twenty second, Cellucci filed for a keep on proceedings, pending the end result of a then but to be filed enchantment.

As at time of publication, the courtroom has but to rule on Cellucci’s request for a keep.
